About the Platform

Kavkazland.com is an online marketplace that connects independent Travel Experts (tour guides) with Travelers seeking small group tours and travel experiences around the world. Kavkazland is a technology platform and marketplace only. We are not a tour operator, travel agency, or travel service provider. We do not own, operate, manage, or control any of the tours listed on our Platform.

All tours and experiences are operated by independent Travel Experts who are third-party users of our Platform. Kavkazland facilitates the connection between Travelers and Travel Experts and processes payments on behalf of Travel Experts as their limited payment agent.

Use of the Platform

You must be at least 18 years old to create an account and make bookings on the Platform. By using the Platform, you represent that you meet this age requirement. You may use the Platform for personal, non-commercial purposes only, in accordance with these Terms.

The Platform and all its content are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without prior written permission from Kavkazland or the respective content owners.

Accounts

To access certain features of the Platform, including making bookings, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at viktoriia.strazhnikova@gmail.com.

You agree to provide accurate, current, and complete information when creating your account and to keep this information up to date. Kavkazland reserves the right to suspend or terminate your account if any information you provide is found to be inaccurate, false, or misleading.

Bookings

When you submit a booking request on the Platform, you are making an offer to the Travel Expert to participate in their tour at the stated price and conditions. A binding contract is formed between you and the Travel Expert when the Travel Expert confirms your booking. Kavkazland is not a party to this contract.

You are responsible for reading the full tour description, itinerary, what is included and excluded, and all conditions before booking. Any questions about the tour should be directed to the Travel Expert via the Platform messaging system before booking.

Kavkazland does not guarantee the accuracy of any tour listing content. We encourage you to conduct your own due diligence, including reading all available reviews from previous travelers.

Payments

All payments are processed through the Platform. The total price displayed on the booking page includes the Tour Cost set by the Travel Expert and any applicable Kavkazland Service Fee. Kavkazland's Service Fee is charged to Travel Experts, not Travelers — you pay only the Tour Cost as quoted.

Payments are processed securely using industry-standard encryption. By providing your payment details, you authorise Kavkazland to charge the full amount of the booking to your chosen payment method. Kavkazland acts as the limited payment agent of the Travel Expert for the purpose of collecting your payment.

All prices are displayed in the currency selected by the user. Currency conversion rates, if applicable, are set by your payment provider and may vary. Kavkazland is not responsible for any currency conversion fees charged by your bank or card issuer.

Cancellations and Refunds

Cooling-off window (platform rule — cannot be changed by operator): Every booking includes a short penalty-free cancellation window from the moment of booking. You may cancel within 30 minutes of booking for a full refund, card fee included, whatever your departure date. After this window closes, the tour's cancellation policy applies.

Kavkazland default cancellation policy: Unless the operator has set a custom policy on their listing, the following tiers apply based on how many days remain before departure at the time of cancellation:

• 30 or more days before departure: Full refund, less a 1% processing fee — the card fee, which the payment provider does not return to us when we refund you.
• Repeated use of the cooling-off window: every booking includes the window, however many you make and however many travellers are on each. What counts is using it: if you have cancelled inside the window twice in the previous 30 days, bookings made after that come without one, and the tour's cancellation policy applies from the moment you book. A booking cancelled by the Travel Expert, or by us, is never counted against you, and neither is one you cancelled after its window had closed. The count is per booking, not per traveller, and it clears as those 30 days pass.
• 14–29 days before departure: 50% refund of total tour cost.
• 0–13 days before departure: No refund.

Operators may set a custom cancellation policy on their listing, which will be shown to you before you pay. Custom policies may be stricter or more generous than the default. The policy snapshotted at the time of your booking is the one that applies to you, regardless of any later changes by the operator.

Children's pricing: By default, children aged 2–17 are charged at 85% of the adult price. Operators may set a specific child price on their listing, which will override this default. This is shown on the tour detail page before booking.

If the operator cancels (platform rule — cannot be overridden): If a Travel Expert cancels your confirmed booking for any reason within their control, you will receive a full refund of all amounts paid, regardless of the cancellation policy or how close to departure the cancellation occurs.

If the operator changes material tour details: If an operator makes significant changes to a confirmed booking (such as price, meeting point, accommodation, or cancellation policy), you will be notified by email and given a penalty-free cancellation window to cancel for a full refund. The window length depends on how close to departure the change is made.

Force majeure: If a tour is cancelled due to natural disasters, government travel restrictions, or verifiable extreme weather, Kavkazland will work with the Travel Expert to offer an alternative date or a refund, subject to the specific circumstances.

Refund timeline: Approved refunds are returned to your original payment method. Payment card refunds typically take 5–10 business days to appear, depending on your bank.

User Conduct

You agree to use the Platform in a lawful and respectful manner. You may not use the Platform to:

• Post false, misleading, or fraudulent content of any kind;
• Harass, abuse, threaten, or otherwise harm any other user of the Platform;
• Scrape, crawl, or otherwise extract data from the Platform using automated tools;
• Attempt to bypass any security measures or access areas of the Platform you are not authorised to access;
• Engage in any activity that disrupts or interferes with the normal operation of the Platform;
• Contact Travel Experts or Travelers outside the Platform for the purpose of completing a booking and avoiding Kavkazland's Service Fee;
• Post fake reviews or reviews for tours you did not participate in.

User Content

By posting any content on the Platform (including reviews, photos, messages, or profile information), you grant Kavkazland a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with operating and promoting the Platform.

You are solely responsible for any content you post. You agree not to post content that is defamatory, obscene, unlawful, or that infringes any third-party intellectual property rights. Kavkazland reserves the right to remove any content that violates these Terms or that Kavkazland determines, in its sole discretion, to be harmful or inappropriate.

Limitation of Liability

Kavkazland provides the Platform on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Platform or the content, information, materials, or products included on the Platform.

To the fullest extent permitted by applicable law, Kavkazland expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Kavkazland will not be liable for any damages of any kind arising from your use of the Platform or any tour booked through the Platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Kavkazland is not liable for the actions, omissions, errors, representations, or any other conduct of Travel Experts or Travelers. Your interactions with Travel Experts and participation in any tour are at your own risk.

Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection, use, and disclosure of your personal information as described in the Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which Kavkazland operates. Changes to These Terms

Kavkazland reserves the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
